Real Estate Law Counsel And Representation

A Generalized Definition Of Real Estate Law

This is a rather expansive area of law governed by federal and state statutes, as well as common law (law developed by the courts). Many aspects of real estate law overlap with contract law. The terms "real estate", "realty" and "real property" are sometimes used interchangeably. However, most people associate "real estate" more closely with the structures or buildings and the land.

Still, real estate encompasses more than just the visible structures. It also comprises most things attached to or belonging with the land. This would include immovable structures such as buildings, houses, trees, bushes and unmined minerals within the land.

Additionally, it consists of the interests, benefits and rights that are recognized by the law. These may include, among other rights, the rights to the air above the land, the minerals or other deposits beneath the land, and the rights to live on the land for a specific period of time or to acquire the land at some point in the future.
